Legal Question in Personal Injury in Georgia

A tree fell through my car windshield while it was parked in the lot of my apartment. Is the property owner responsible for covering the cost of my windshield replacement? The tree is visibly diseased.

If the tree was visibly diseased (from the outside, nut just after it fell), you might have a decent argument to request the owner pay for the damage. Pictures of the tree and vehicle would certainly help. If the tree was not noticably defective prior to falling, or the wind blew it down, it would be a different story.

I agree with the prior answer. In addition to that information, you may want to contact your automobile insurance company to expedite the repairs of your car. They will go after the owner and its insurance company. This should save you time and the contingency amount any attorney will charge for representing you.

The simplest answer (and I agree with the others) is to make a claim with your insurer and let them go after the apartments.
