House remodeled

Final payment is due, but i am dissatisfied, the contractor has placed scratches in my bathtub from not protecting it before placing porceline tile in the bathtub,the contractor refuses to acknowledge it how this can this be handled, do i have the right to refuse to give him the fina l payment,oe demand that he gets the scratches out of my bathtub

I think you are justified in withholding final payment. Take plenty of pictures. Also, be prepared that he may file a lien on your property. Consult with a local attorney.

Until the contractor has repaired any damage done to your house in the course of his work, he has not completed the contract, and is not entitled to final payment. You have the right to demand that he repair your bathtub, and you should make this demand in writing before withholding payment. Be aware, however, that you do run the risk of having a lien filed on your house. Check the terms of any mortgage on the property,to make sure that the mere placing of a lien is not a default. If it is, or you are not sure, consult an attorney immediately.

If this matter is not resolved amicably, you must consult an attorney to protect your rights.
