Two party agreement one party abandoned

My father and I purchased a home together. We were to split the note. One month into living in the home he walks out. No warning, he is just gone with no forwarding address. That was in 2005. I have had to hold down a mortgage above my means. What can I do to get his name off the deed so I can refinance at a rate I can afford. Can I file for abandonment? or suit for default of agreement on his part?

Consult with a local attorney. There is probably a way out of this situation, but all the documents will need to be reviewed.

There are legal remedies which would enable you to obtain title in your name alone. You do not give enough information to give any opinion on which remedy is in your best interests.

However, any remedy will require filing a lawsuit, and you should retain an attorney to advise you of your rights and file suit on your behalf.
