Legal Question in Wills and Trusts in Georgia

If someone forges a will and obtains an estate fraudulently what will be their punishment when or if they get caught, they are selling the properties and cars and they forged the will I am very mad about the situation i dont know what to do

The longer you sit back and do nothing, and wonder about a criminal case a year or two down the road, the more money will disappear to be never seen again. From your post that is what is happening. If it is really important, call probate or probate litigation lawyers today and make appointments.

Who are you and how are you affected by this? If you are an heir or beneficiary of the estate (but for the allegedly forged will) then you need to run to a probate lawyer who practices in the county/state where the estate is pending. The lawyer needs to file what is called a caveat challenging the will as a forgery. The lawyer also needs to get an immediate restraining order precluding the executor under the forged will from disposing of any assets.

However, litigation costs money, and will caveats and such are not going to be cheap. You had better be certain that you will be able to prove the forgery and that there are sufficient assets in the estate to make such a legal proceeding financially worthwhile. This is not a contingency fee case nor is this something that Legal Aid typically would handle. Assuming that you succeed then criminal charges can be brought for forgery.
