Legal Question in Wills and Trusts in Georgia

I live in Atlanta GA. My daughter pasted away in San Diego CA. with no will. How can I be named exectitor of her estate so I can close her accounts and pay her bills?

I am sorry for your loss. You will need to talk to a lawyer in San Diego, California if your daughter resided there.

Every state is different but it depends on what your daughter had. Some states have procedures where you can gather assets through a simplified process rather than full probate. This would allow you to get monies from bank accounts. However, it will depend on what debts your daughter had too and what she owned, its value and how it was titled.

If your daughter actually lived in CA, then you will probably need to hire a probate lawyer there to guide you through the process. Failing that, you will have to speak to the register of wills/clerk of the probate court (or whatever they call it out there) in the county where your daughter lived at the time of her death. The probate court will have the necessary forms. Many can be accessed free of charge online but you first need to speak to someone to find out about the probate process and whether you actually need to do a whole probate.
