Legal Question in Wills and Trusts in Georgia

My sister and I own property together. I would like to sell and she does not want to sell and she is currently living in house on property. How should I proceed in order to sell and is there any compensation that I can receive from her and her boyfriend currently living on property?

You would have to sue her for partition in Superior Court. You'd need a lawyer. In a partition, the court will force a sale, which usually will be at a very low distressed price as buyers will know the sale is forced, and you and your sister would split, after legal fees, whatever is left. A partition suit might also cause your sister to want to negotiate, as she would have to move.
