Legal Question in Personal Injury in Hawaii

if two people get into an accident and one has no insurance and both parties leave the scene but file police reports an hour later and upon talking to the insurance company they deem it to be a no fault and close the claim can one party still take legal action against another?

If you were injured and your medical expenses reach at least $5000 then you may bring a claim against the other driver through his/her insurance company or you may try and settle the claim directly with the other driver if he/she has no insurance or you may bring a legal action against the other driver. With regard to property damage, you may bring a claim against the other driver regardless of whether you have any medical expenses. You can settle the property damage claim with the other driver or take him/her to court.
