Legal Question in Family Law in Idaho

gaurdian of a minor

My father and step mother went to court in Twin Falls Idaho to get gaurdianship of my 16 year old son to enroll him in school while I was in California going to court with his dad. Under the condition it would only be till I got out there. Now they refuse to let me have contact with my son. What can I do about it? And what kind of legal rights do they have that I don,t have now? What rights do I have?

Take the California custody order and the guardianship order to an attorney in Idaho and have the attorney review them. The facts which led to the guardianship would be a factor in determining your next step.

If the temporary guardianship's condition precedent has been satisfied, then the temporary guardianship should legally terminate at this time, absent any other relevant conditions precedent. Meaning, you would be entitled to custody of your child again if you have satisfied all the conditions associated with the temporary guardianship ending. However, your best option here would be to retain an attorney to review the guardianship paperwork that you have in your possession and advise you on your next legal steps in regaining prompt custody of your child hereafter, especially if the guardians at issue currently are being uncooperative.
