Can my son use his dad's family name?

Can my coming son use his dad's family name? were not married yet but plan to get married when he got his Us citizenship first and petition us to come to USA. Im afraid during the petitioning time here at US embassy (Philippines) gonna question me and give me hard time because me and my son dont have the same family name...please attorney help me...

Yes, your son can use his dad's family name. If your boyfriend will not be in the Philippines at the time of your delivery and cannot sign the birth certificate of your child, your boyfriend must execute an Affidavit recognizing your son as his son and also an Affidavit allowing your son to use his surname.
