At my job they pay for ins for some and none for others is that legal

Yes. Even under the Affordable Care Act employers who otherwise have to carry insurance for full-time workers do NOT have to for part time, and there are other exemptions. So if you want a specific answer, you have to be more specific about your workplace situation. But the point is that where the employer is not required to carry you, and even if so, you can STILL choose to apply for healthcare insurance through the federal website and/or your own state's exchange (if your state has not opted out).
