Legal Question in Business Law in Illinois

I am a assistant manger @ Wal-Mart and they are re-doing there management structure and I might be told I am going to be stepping down to an hourly position from a salaried position ....

The question I have is:

Do I have to take a demotion or can I tell them "no" and they have to fire me so I can get unemployment benefits? Or, if I tell then no is that job abandonment and I simply get nothing? I would rather not take a demotion, do I have to if told to?

And what legal recourse would I have if they down size me?

Generally Illinois is an "at will" employment state.

If you do not have an emplyment contract you are an "at will" employee.

If you have a contract review it. If you are an at will employee consult Wal Marts employee handbook.

Consult wit an employment law attorney.
