Re: purchase order

It depends on state law and the terms and conditions of the purchase order. If what you ordered is goods then the UCC will control the purchase. If the terms and conditions of purchase were to have the price of the goods at the time of delivery then the price can vary. If the purchase order was for a fixed number and the price per each was agreed to before the purchase order was issued. Then the supplier must furnish the goods at the price originally agreed to. This may sound cumbersome, however based on the submittal, I cannot be more specific since I am not a member of the Pa Bar, nor do I know all of the facts of the case.

Good luck!
