Collecting a debt from a family member

I lent my brother $3500 1/00. He was "desperate", getting kicked out of his house, etc. He has borrowed much money in the past-never paid back. He promised to pay it back within 2 weeks. He has not paid-I have made SEVERAL attempts to collect. Now he claims he doesn't have it, is behind 4 mths in mortgage payment, etc. I have a cancelled check plus I confided in few people when I lent him the money. I recently moved to California and do not have a job yet-I really need the money. I have been more than FAIR and patient and I don't like the "you'll get it when I have it attitude". I need to know what my options are.

one option only. sue him back in his home state.
