Legal Question in Credit and Debt Law in Illinois

I loaned someone a large sum of money and was recently granted a judgment against him. I would like to get a garnishment on his wages but I'm not certain where he works. He also owns property and recently sold one of his properties. What can I do to get this judgment honored. Thank you.

Thank you for your question. Your best course of action would be to first file what is called a Citation to Discover Assets. This compels the defendant to come to court be examined by you - if he fails to appear you can have an arrest warrant issued. If he appears, you can ask him where to banks, what property he owns, etc. This information will allow you to successfully garnish him. I am, of course, summarizing the steps you need to take. There are some nuances you need to be aware of. Please feel free to contact me if you have any questions. My email is [email protected]

Thanks,

Mr. Tracy has summarized the process rather well.

However the reality of each and every situation differs according to the facts.

Often in many cases the hardest thing to do is to collect after the judgment.
