Legal Question in Criminal Law in Illinois

Domestic Violence Enhanced Offense

My husband has served time in prison for domestic violence in the past. He has been recently diagnosed with bipolar didorder, which is a lot of the reason for past violent outbreaks. He now is on medication. My daughter has recently come to stay with us. On January 5th 2006 we were celebrating my husbands b-day & had a few drinks. My husband & my daughter had not been getting along & they started arguing. My husband broke a few things in the house & then told my daughter to get out & not come back so my daughter went next door & called police. Mu husband then left the residence to cool off. The police came to talk to my daughter. She stated she wanted him off the property. They said the only way they could remove him is if she makes a statement that he had harmed someone. So she went up to the police department & made a statement that he had grabbed me & put me up against the wall. This is not true, but later they arrested him anyway. My daughter since has recanted her statement & said that this did not happen & that she is sorry that she did not want anything serious to happen to my husband, she just wanted him to be removed from the house. I have also made a statement that he did not harm anyone. My huband is on probation.
