An attorney should certainly have more facts to work with before agreeing to take a case upon a downpayment and installments to follow on attorney's fees. What is your son charged with? What court is your son facing charges in? What are the facts behind the charge(s)? You may call me for a free telephone consultation, and I may be able to help. I have been handling criminal cases for over thirty years.

If I understand your question correctly, you are asking if you can make payments to a lawyer for his or her fee. I assume that you don't have enough money to pay an entire retainer up front. Some lawyers may be willing to make an arrangement like this and others will not. You will need to call around and see what the lawyers in your area are willing to do.

What kind of trial is it? Depending on what the matter is, lawyers will be more or less willing to allow for payment plans.

If this is a criminal matter, you may be eligible for a public defender. If this is a civil matter (you are being sued) then you cannot get a public defender, but you may be able to work something out.
