What is my husbands legal right?

My husband was citated for driving on suspended license, no insurance, speeding and fleeing from the police even though he was not properly indentified.The police arrived at my door because the car involved was at my home and is my car but was taken by my husbands cousin whom he had been drinking with earlier in the night.My husband did give his cousin the keys to our car to drive to a friends home, he was supposed to return in a couple hours.The police arrived at my door about 30 minutes after his cousin had left.My husband woke me,intoxicated, half asleep, confused.I let the police in and they accused my husband of being the one in the car, gave him citations, even though 2 neighbors seen it was not him.After the police left we discovered his cousin was in our bedroom closet,the officer did walk through but did not look in any hidden spaces.My husbands cousin has no permanent address in our city, we dont know where to find him,he just stops by every now and then.My husband is already in the court process now, his license are suspended/revoked and we dont know what to do now.My husband does have a laywer who is working on his case now(driving on suspendedx2,leaving the scene of an accident).Can he be charged without proof?Thanks
