Legal Question in Criminal Law in Illinois

price tag switching. if a person walks into a store and switches price tags on two shirts. one valued at $10 and one valued at $100. so he puts the $10 tag on the $100 shirt and then puts the $100 tag on the $10 dollar shirt. he takes the shirt with the now $100 tag on it and goes to pay for it. (shirt is valued at $10) so basically he"s paying $90 more than the store was asking. is that a crime ? can he be prosecuted ? he did not steal, he actually gave the store 90 more dollars than they asked for.
