Legal Question in DUI Law in Illinois

I was arrested back on February 13, 2009 for a DUI. My attorney stated that I got off because the officers never asked me if I was the driver of the car. Can I sue in small claims court against the Orland Police Department for wrongfully arresting me and get payment back for me having to pay $500.00 to the Police Station before I could even get my car out of impound that cost me almost $400.00 and the fees I had to pay for my attorney. I would ask my Attorney but do not want to be charged the enormous fee just to talk to him for 15 minutes. Thank you for your help.

No. On another note, I assume you were driving? In that case, you might count your blessings and be thankful that you got out of a DUI charge with no more than attorneys' fees and impound costs. Your situation could have turned out much worse.
