Legal Question in DUI Law in Illinois

possession of alcohol by a minor.

My 18 year old daughter was in a car with two 21 year old individuals when they were pulled over for a traffic violation. She was seated in the back seat with two other minors. There was a twelve pack of beer that the 21 year olds had bought earlier. It was unopened. The 21 year olds claimed possession of the beer as they had truly bought it. The officer gave her a ticket for possession claiming that her feet were closest to it so it was considered hers. Is this correct? I always was under the impression that the person who is driving the car is in posssession. If she really had done this I wouldn't ask . But, she was merely seeking a ride home, and the beer was already there. Please let me know if we have a legal right to oppose this charge against her. Thank you

Hello! You certainly have

a legal right to oppose this

charge against your daughter.

In my opinion the police

officer acted unreasonably.

Retain an attorney and fight

it!!!!!
