Legal Question in DUI Law in Illinois

Former Sherriff charged with drunk driving

The former Sherriff of our county was charged with a DUI after rear ending my 17 yr old daughter. What I am having a problem with is that I have spent my entire life telling her how dangerous it is to drink and drive. She was not extremely injured in the accident just a little sore nech and shoulders. This person who is to be upholding the law, BROKE IT! I would like to sue him for the anguish he has placed on her and my family. please tell me what legal matters I can take.

Re: Former Sherriff charged with drunk driving

You can in fact sue the individual for damages to your vehicle and for injuries to your daughter. The suit is generally the same as it would be in any auto accident case. The outcome of the DUI case generally has little effect upon your suit, unless the individual were to plead guilty, in which case that plea could be used against him in the civil case. You should also talk to the prosecutor who will be prosecuting the offender, it is possible that restitution for damages to you and your daughter may be part of the criminal sentencing process.
