Legal Question in Family Law in Illinois

Dear lawyers, Im married with an American citizen for 3 years and just found out he is having an affair. Im Brazilian and Im in the process for my 10 years green card. I also have a daughter (19 years old), from a previous marriage, that just moved to U.S. for college. She is also a permanent resident because my marriage. Im feeling very insecure because I just lost my job and have no place to go with my daughter in case of separation. What are my rights? When we got married he already had an apartment in foreclosure and we join efforts to renegotiate the debt. Do I have any right on this apartment? Does he have to give me financial support while I dont have a job? Can I and my daughter lose our green card? I would appreciate any help in this case. Thanks!

My name is Tanya Fajardo, and I am an immigration attorney who shares an office with the divorce attorneys you had contacted. In regards to your immigration issue, did you jointly file an I-751with your husband? If so, when did you file? Usually you have a set amount of time to amend your petition to a waiver petition, so that it does not affect you losing status as a legal permanment resident. Shoudl you chose to legally separate from your husband, I would be happy to assist you with this process. Here is my contact information if you are interested in scheduling a consultation.
