Legal Question in Family Law in Illinois

my ex-wife has custody of our daughter. Our daughter is now 18 and graduating from high school next month. She plans on moving out of her mother's house immediately after graduation and be independent. My ex-wife is now threatening to sue for college tuition. Can she still sue if our daughter is not living with her or does it matter where the child is living?

Yes. If you daughter is attending college, she has the right to seek contribution from you. The only she would not would be if your daughter came into court and said she wanted no contribution from either parent.
