Family

Im a single mother living in illinois and relocating to wisconsin. My daughters father is $8000 behind in child support and has never been a part of her life. Can he prevent me from leaving the state? if so, what can i do?

In theory, yes. But he would have to file the appropriate motion to fight you having left, and then you would file a Petition for Removal, which it sounds like you would probably win. But the process can be frustrating, depending on how gung ho the father is.

Unless there is an agreement between you and the Father that states otherwise, you are required to file a Petition for Removal in the county where the child resides to obtain permission from the court to move outside of Illinois. As part of the Petition, you will need to prove that it is in the best of the child to relocate to Wisconsin. Father's lack of involvement with the child and the amount of child support owed are strong factors in your favor in proving best interests.
