Legal Question in Family Law in Illinois

I have been legally divorced since 2010. I was awarded sole custody and control of my son. My ex husbands rights are still in place however there is no visitation agreement. I filed through the state for child support for the first time ever recently. In response he has told me he's going to try and voluntarily give up his rights. Can he legally do this to try and get out of child support? I have an email saved stating that's why he's wanting to. Also my son is on state insurance. My ex also has another child who he currently has visitation rights and pays child support.

In Illinois he can not do that. If it were possible many would do that. Only if your son were adopted by a new spouse could that happen. He is stuck support his child until the child finishes college, assuming you seek college contribution at the appropriate time, otherwise when you son graduated high school or reaches 19.
