Legal Question in Family Law in Illinois

I've been married 18 years to my husband. If we divorce do I get half of his 401k and stocks? I live in Illinois and the beneficiary on the 401k.

Not automatic - you are entitled to an equitable portion of the marital portion of his 401k. But you h=may want other assets that offset some of that claim. And you would received your portion as a roll over IRA - and have to pay income tax on anything you withdraw.
