Mortgage Payments

My divorce has been dragging on for ten months. Since I am residing in the marital home (with my college age son), I have been making all of the bill payments. My husband inherited a house, which is completely paid off so he has been staying there. As it has become tougher to pay all of my legal bills, along with my son's tuition and our mortgage payments alone, I finally asked my lawyer to make a motion for my husband to contribute to the mortgage payments. Well, the motion was made back in July. There has been two court dates since. One that was just a continuance and now a date has been set for a pre-trial. However, I have not received anything from my attorney about my husband being required to help me with the mortgage payments (the house is in both mine and my husband's names equally). I hate to make phone calls or write more letters to my attorney, which I will be charged for. However, I don't understand if it should take this much time for the court to make my husband pay a portion of the mortgage. How long does this usually take? Is there anything else I should be doing? Of course, I am continuing to make all payments on time but it is getting very difficult.

Hello. First of all I suggests that you make an

appointment to see your attorney about your concerns. Also, write him, if you call him and

do not get a response. He may be in a trial or

temporarily overwhelmed in dealing with another

case. You may want to ask your lawyer about

filing a motion for your husband to contribute

to your son's college tuition and room/board

expenses. By being proactive in your case, you

can better assist your lawyer in helping you.
