Legal Question in Family Law in Illinois

I received the answer to my last question which said that my husband who lives on PA can divorce me even though he admitted that he is "messed up in the head" . The answer also said that I can ask the court in Illinois to order that the other party undergo psychiatric testing.

Can I do that even though he lives in PA and if he tried to file it probably would be in PA? Since we were married in IL does he have to file in IL?

Good question. I can only speak about Illinois law. If your husband has lived in PA for some time, I'd be willing to bet he can file for divorce there. In Illinois, you only need to live in the state for 90 days before filing a divorce petition here. You both essentially could file for divorce, and the court here would actually communicate with the PA judge to decide which state should handle your case.
