Legal Question in Medical Leave in Illinois

Fmla

We are a firm of seven employees. We have an employee leaving for maternity and we are giving her 12 weeks, no pay. Do we have to hold her position open with the same salary. What are our requirements. Thank you.

Terminating an employee under such circumstances can expose a company to significant risk, whether or not the employee has a leg to stand on. Be very careful. I strongly recommend you talk to an attorney regarding this type of issue.
