Legal Question in Employment Law in Illinois

I am 63 employed for 15 yrs w/current employer. I have gotten stellar reviews. Can I be terminated for being over budget and because of it be accused of misconduct & the company's loss of a new client's contract. Am I a scapegoat?

Thank you for your question. As an "at will" employee, a company is afforded with wide discretion to terminate employees. The biggest reason may be cost concerns - you simply may earn to much and the company is seeking to save money. What a company cannot do, however, if terminate an employee for non-performance or financial considerations. This would included, specifically, age. In Illinois, an employer does not need a reason to terminate you. However, if the employer seeks to prevent you from getting unemployment benefits, they must have a good reason as defined by statute (typically misconduct). Our firm has a long history of repres nting employees in situations like the one you describe. Age discrimination is very difficult to prove and it often in an employee's best interests to negotiate, with experienced counsel, a decent "exit" package if it is suspected your employer wants to terminate you.
