If your criminal record is sealed but not expunged is that released in a background check? Is the law in Illinois to all a private company to go back for only 10 years when doing a background check?

A sealed criminal record generally cannot be viewed by a prospective employer doing a background check, unless the prospective employer happens to be a law enforcement agency such as a police department. It is my understanding that even if there is an expungement, law enforcement agencies are still able to access the information.
