Order of Protection and TV

My life and my daughters life was threatened so I got an emergancy order of protection. The guy it's against bought me a TV for my birthday (he still owes 1,800 on it) wants it back. We went to court for the restraining order and now he wants the TV back. Can I win this case and keep my TV

In my opinion, you should be able to get a two year order of protection. The tv is another issue. If the court bars this gentleman from your home and rules that the tv is a gift that you can keep, great.... but you may end up having to pay for the tv on a theory of equity.... that's a whole different issue. On the other hand, the court could grant you the order of protection and then direct the gentleman to get police to escort him to your residence to retrieve the tv.
