Tubal reversal-reversal

I had a tubal ligation performed in '93 after the birth of my 2nd child. For 9 yrs. following I had severe pain. In '02 I finally received an operation to remove the hulka clips. Before this process was done I specifically explained to my Dr that I just wanted the clips removed not another tubal,(cutting of tubes)because I planned on having another child in the near future. The Dr agreed not to cut my tubes. Two days after the surgery I called the hospital where the surgery was performed and was told I was given another tubal(a stitch in both my tubes to disconnect them)I want to know what I can do since I specifically told the Dr not to perform a tubal of any kind. I was sent a bill for over $15,000, and it clearly states a tubal reversal was performed. Since I have insurance I do not have to pay but, this Dr has now ruined my chances of ever having children naturally again. Too much tube is damaged.this procedure did not have to be done she did it on her own accord. Is this malpractice.

Whether malpractice has occurred largely depends on the records and the reason why the doctor did what she did. If the records show that she has deviated from the standard of care in the community in which she practice, then you have a great case and should pursue it without delay and seek a competent lawyer to look at the details. You must get a second opinion. First thing you must do is to get ALL your records from the hospital where the surgery was performed. You then must either take it to a lawyer's office to have it reviewed or do it on your own and take to another doctor in a similar field and have him or her look at the records an give you his or her opinion as to any possible deviations from standard of care. If there was, you must file suit right away. Malpractice cases will not be resolved (in my opinion) without a lawsuit filed.
