Legal Question in Personal Injury in Illinois

I had 2 level cervical disk replacement Nov 11, 2010. I was still going to Physical therapy 2 times a week with up and down results on Sept 1st, 2011 when a car pulled right in front of me on the way home from PT and after trying to avoid the accident, still t-boned his car. Our car was totaled. There were plenty of witness�s and the other driver was sited. He also had the same insurance company. Of course I was shook up and did not think I was injured. I went to the hospital the next day and had x-rays taken for my surgeon. No hardware was damaged. Having difficulty with extreme muscle pain going back and forth, I explained over and over that I would not be able to say exactly where one stopped and the other began. My therapist felt I had been doing a little better, but we were used to it going back and forth because of the serious changes in my neck. My Mother died 3 days after the accident and I traveled to Florida to spend her last night with her. I honestly did not know if I was coming of going. I lost some therapy time due to the accident, also because of my Mom's funeral and then because we only had one car until we got a deal on a new car. I went back to therapy and then the stress of my health insurance declining and sending the bills to the auto insurance. I was dealing with my bills not being paid and actually got one letter from a doctor that was turning me over to collection. The main auto insurance office seemed to be handling the claims, but were letting things slip through the cracks. I have had problems with anxiety for years and this only made me worse. I ended up not going back to PT and tried to work out and do PT at home with no success. I was uncomfortable about going back to PT because of the payments. The auto insurance feels I was getting better and they are not responsible. How can you possibly know the difference and how it affected a problem. I could not tell. So---I am back to the level of pain that I had after surgery and the insurance company sent me a letter to settle for 8000 which was inclusive of over 5500 in medical bills. I don�t feel it is enough for me turning the wheel, getting my arm burned on the air bag to not kill the guy and then dealing with all the stress. I was dealing with emotional problems from pain before the accident and am right back where I started. Do I have any rights.
