Legal Question in Personal Injury in Illinois

I have an injury case question. My sister was putting away her groceries in the back of the truck (this happened in the grocery store parking lot) on Dec 7, 2008, Sunday when a car behind her, pulling out of his parking space, suddenly hit her and pinned her to the truck. The ambulance and police showed up. Witness appeared from everywhere and stopped the driver. The man who hit her didn�t have a license, but did have insurance through his wife, but he said it runs out in ten days. We got the information. The police arrested him and took him away. My sister was feeling sour, so we convinced her to go to the emergency room and get checked. When she informed them she didn�t have health ins., they just felt her and sent her home. She has big, ugly bruises on both legs and her stomach. She takes care of our father at home and baby-sits her nieces. I am making sure she doesn�t do too much. What should be the monetary request from the insurance co. besides the emergency bill. Can she request pain and suffering for the bruises? Please respond as soon as possible.

This is way too early to discuss settlement or what you should be asking an insurance company. the fact that the insurance runs out in ten days has not effect since the injury occurred within the policy period.

Also, depending on the factual circumstances, your sister may be covereed for medical care through her auto insurer. If for example, she was partially in the vehicle when she was hit, there is a pretty good chance there is coverage, depending on how her policy is written.

She should contact her own insurer.

Your sister is entitled to recovery of: 1) all her medical bills (present and future); 2) all her wage loss if any; 3) all out of pocket expenses (heating pads, drugs...): 4) pain and suffering; and 5) her loss of normal life.

The fact that the insurance runs out in 10 days is of no consequence--so long as there was insurance at the time of the event, there will be coverage.

Also, your sister should see a doctor. How does she know if there is no hairline fracture or other internal damages that will manifest themselves at a later date? She can go to Cook County Hospital or she can talk to an someone and get a referral for a doctor who is willing to provide treatment and wait to get paid form the proceeds of any settlement.

The best recommendation is for your sister to talk to an attorney. I will be more than happy to provide her with any further guidance she needs. Consultation with me is free and I work on a contingency basis -- that is she does not have to pay me until I am able to make a recovery for her.

If not my office, she should talk to an attorney--She should not try to settle her case on her own. The adjusters are not trustworthy persons and are trained to shortchange decent honest people who have been injured as the result of someone's carelessness.
