Parking lot injury

My wife was pushing a shopping cart out of a large chain retail store with our son in the ''child seat.'' As she approached the isle where our car was parked, she accidently pushed the buggy into a huge pothole. Her leg hit the bottom and she got a wound. She had to go to the ER. We are asking the store to pay for the med bill, that's all. They say the landlord is responsible. We're afraid they are blowing us off. Who is responsible?

Why would you want to only get your medical bills? You are entitled to get compensated not only for the medical bills incurred, but also for any out of pocket expenses along with the pain and suffering and any wage loss experienced as a direct cause of the injuries sustained.

The property owner is usually responsible. However, it is possible that the store may have taken on the responsibility to fix or to make any repairs in the parking lot. No matter who is responsible, it is not your problem to sort these things out. You should talk to an attorney who will issue a lien to both them bozos. Once you file a lawsuit against the both of them, they won't be able to give you the run around for too long.

The landlord may be responsible - it depends on the store and property owner's agreement. An attorney could probably help you by intervening on your behalf to make them move somewhat quicker.
