Legal Question in Personal Injury in Illinois

Should i sue

I recently stepped in a hole on someone elses property. I tore my miniscus and had to have surgery. They said they didn't know about the hole therefore they couldn't fix it and are not responsible for the injury. Do i even stand a chance if i wanted to sue them.

You do have a case. The issue is not whether the owner KNEW about it--the issue is whether the owner through the exercise of reasonable care SHOULD have known about the dangerous condition that caused your injury.

The question is not whether you should sue, but whether you will recover. The answer, as it usually is, is that "it depends". The best way to determine the liability in your case is to take pictures of the "hole", and have an attorney look them over.

I think that the exact factual situation would need to be evaluated.

Where exactly was this hole? In a yard, driveway, inside?

Why were you on the property? Social situation, business situation?
