Dear Attorney:

Please give me an advice. We rented a house to client X. Client X moves out, leaving us with Dog's pee through out the house and few plumbing repair.

New client Y visited out house, they liked our house. Y signed lease, they paid security deposit and first month's rent. We handed over keys to Y. Later after Y moves in, lived in for few days, now Y's wife came in. Y's wife smells Dog's Urine.

We had clean the house professionally, who ever entered in the house, they all said nothing smells. We will got it cleaned. OK, new tenants still smells and keeps complaining for one of the other problems on daily basis.

I went ahead and replaced carpet in the living room and master bedroom on the 1st floor. Again Y complaints it still smells. I advice them to get carpet replaced in the rest of the house on your own or sign least for at least 5 years or pay higher rent. Y did not liked it and said they are more than welcome to move out.

It took well over 20 days of the 1st month after Y moved in the house. Y was living in house, not his wife. Y was in the possession of keys. Lease was signed and its broke now.

Y wants all his money back. two them. Now all these are getting together including previous tenant X - threatening us for THEFT and BREACH of CONTRACT. We did not breach anything. All is done by them. Can they sue us?

Anybody can sue anybody. Whether anyone can win....is a different story. Someone needs to review your lease for several things: whose names are on it as tenant and who signed it as tenant, what the representations were about the condition and whether the tenant had the opportunity to inspect before moving in, etc. Also, the lease with X needs to be reviewed. Until that minimum review is done, really nobody can give you any good idea of what your rights or liabilities may be.
