Foreclosure in Illinois
My sister was served with notice of foreclosure April 2005 from the mortgage company that holds her 2nd mortgage. She is current on her first but completely behind on the 2nd. The action was filed in December and the date to be out is July 15. She is telling my mother (who lives with her) that they have 30 days after July 15 to vacate. Is this true?

My sister is also telling my mother that they are filing chapter 13 on Saturday. I thought you had to file Chapter 13 before a certain point in the foreclosure process otherwise you would still lose the house.

The operative question is whether the sheriff's sale took place; this is a question that you should be asking your bankruptcy lawyer.
