Forgery

I have discovered that my ex-husband has been forging my signature on mortgage re-fi documents as well as quit claim deeds and power of attorneys. He was able to do this with the help of his good friend who is a mortgage broker. These actions have diminished my marital assets considerably. Can I take legal action against the mortgage co.? And if so, is it a civil matter, or can I contact the state's attorneys office?

In addition to contacting the States Attorney and your own attorney, you should also contact the Division of Banking at 877.793.3470. This broker needs to have his licensed revoked. There may also be some unauthorized practice of law violations as well. Unbelievable.

The forgery is a violation of both federal and state criminal law. If the mortgage broker has been participating in this fraud, or even knowingly allowing it to occur, then he/she can and probably should be prosecuted criminally. You can go to the State's Attorney's office or to the U.S. Attorney's office.

In addition, you should be able to recover your loss, as well as possibly enhanced damages civilly.

Hello. In my opinion you can file a lawsuit

against the mortgage company. With regard to

the forgery, it probably is best to make a police

report and take the report to the office of the

state's attorney to see if they will prosecute

your ex-husband and his friend. I will be happy
