Legal Question in Traffic Law in Illinois

Am I at fault? Traffic Question

So I got into an accident that involved two other cars. However, only two of the cars, one being mine and another vehicle, are the only ones that actually crashed. So car 1 spun out of control on front of me and then ends up sideways on the highway thus blocking my lane. All other lanes are occupied with cars so I brake as fast as a i could to avoid hitting the car that spun around. I managed to slow down enough to avoid hitting the car. However, the car that lost control also blocked the lane to the left of my lane thus causing another car to swerve into my lane and hit my car. Who's fault is it? Who is responsible for fixing my car?

Re: Am I at fault? Traffic Question

The way you describe the accident, you should probably seek payment from both of the other cars' drivers. Car 1's driver (the swerving car) appears to have been negligent doing whatever it is that caused his car to swerve. Car 2's driver (the one to the left of you) appears to have been negligent in swerving into your lane. You are probably not negligent in slamming on the brakes or in staying in your lane.

You should also look into why Car 1 started spinning (e.g. if another car cut him off and is also at fault).

You should call your insurance company and have them deal with this. If your insurance is not handling it or you are uninsured, feel free to give us a call to talk about the details.
