Legal Question in Wills and Trusts in Illinois

over the summer, two brothers and a sister have been willed grandma's estate (home), 1/3each, one brother and the sister live in the home, the brother died (Fall 08)intestate his heir apparent wants his 1/3. My question does the cousin (heir apparent) have a claim? The sister (my mom) wants to stay in the home, the cousin wants to force a sale of the home and divy up the proceeds, the other brother who lives out of state is on the sidelines for now.
