Rights with respect to real estate are legally effective only if they are in writing. There is no possible way anyone could counsel you effectively without reading the trust agreement that is written, or if it is not yet written, that which is anticipated. I suggest that you and the testator and your son visit the attorney who helped write the will to go over your concerns so that you can review the property management issues which will arise after the testator's death.
