Legal Question in Workers Comp in Illinois

I was injured at work and work comp sent me to their dr. Dr didn't really do much and sent me on my way. I then went to my dr when the pain became too much and was sent back to work comp dr by my work. This time was told to get a new career and that they could not help me. I am still in pain and have been dealing with this for 6 months or more now. What should I do? Should I sue or just let it go and continue to work with the pain?

If your own doctor says you have been injured at work then you are entitled to make a workers compensation claim. If the work "doctor" and the insurance company are giving you the runaround, then you need to speak with an attorney.

If you don't want to sue, of course that is your choice and that is fine too.

Hope that helps-

Hi. I am sorry to hear about your work injury. I am well aware that the workers' compensation process can be very frustrating, and it sounds like you are not getting the treatment that you should be entitled to. I am an Illinois workers' compensation attorney that handles claims in your area of Illinois.

Often times, your case will get more attention if you have a workers' compensation attorney that is familiar with dealing with insurance companies handling the matter for you. A few additional details would be needed to determine the most appropriate course of action at this point to make sure that you get: 1) the medical treatment that you need, and 2) the full amount of compensation you are entitled to. Have you missed time from work due to the injury? Have you been paid for the time missed from work? Also, has the doctor stated that there is nothing else that can be done and sent you back to regular work duties? These are a few of the details needed for an attorney to make an assessment of the type of benefits you are entitled to and what needs to be done to get you proper medical treatment.

Under the workers' compensation laws in Illinois, in addition to payment of all medical treatment related to your injury, you are also entitled to a lump-sum amount of compensation if your injury is long-term, or if there are permanent effects from the injury.
