Law related to the International law in Dubai (Sharjaha) and in Chile

Dea Sir,

our company is a leading exporters of the chemical products to the world wide for the Pharmaceutical companies. We have exported goods in dubai (Sharjaha) to M/s. Al-razi Pharma L.L.C. and they have nto paid us the payment and the drafts were returned back to us as they were accepted by the Bank of Arab Plc in Sharjaha they owes us to pay in U. S. $ 1,05,092.15/-and now the bank has not yet made us payment as the same case in Chile M/s. Inversiones Dilemon is apharmaceutical company has to made us th epayment of U. S. $ 36.350,00/-. as it is a breach of trust and we hav enot enered into any contract agreement with the parties so gide us for thesame and we wan tto sue the Bank in respective country abovestated. Can we sue the Bank fo rnon Payment of our debts? whether we can file a summary suit in India? what will will be the inernational law related to the recovery of our outstnding dues? Recommend us a specialised advocate India or in respective country so we can proceed furhter for the legal proceedings.

Chile the banks name is Chilede Banco Santiago Chile.

the first thing you can do is to file a suit claiming the dues and damages/compensation in the High Court of the state where from the marchandise was shipped and in the same court file an application for injunction for the purpose of freezing the bank account of the purchaser and subsequently an complaint for criminal breach of trust can also be filed but it is hard to get your money back through criminal proceedings, if you have the documents showing proof of shipping and receiving by the purchaser you are very likely to have court orders in your favour apart from other conditions, for details you may write to [email protected], you do not need any expert on international law as this case is mostly covered by the business and commercial laws, if your office is in West Bengal I can provide assistance in this matter otherwise just find any lawyer who is good at contract act, and business laws.

Option � 1 Give a complaint under criminal breach of trust to the police station within appropriate jurisdiction and file a private complaint in the criminal court of law within appropriate jurisdiction against the bank.

Option � 2 File a complaint in the consumer court of law within appropriate jurisdiction against the bank.

Option � 3 Give a complaint to the banking ombudsman within appropriate jurisdiction against the bank.

Option � 4 Go for an arbitration against the bank if there is any arbitration agreement.
