Can the managing Committee members penalise members for not attending the Annual general body meeting if the same bye law is not registered and approved by the registrar?

Dear Sir / Madam,

Attending the Annual General Body meeting of the Society is the right of a member, and not his / her duty.

A Society cannot propose, approve and adopt any bye-law amendment making it binding on a member to attend the AGM of the Society or any such amendment which if passed will be ultra-vires of the Co-operative Societies Act, or that supercedes the Law of the State. The Registrar is restrained from approving any bye-laws of the Society that are ultra-vires the Act or those that supercede the State Law.
