Cheque Bounce: Civil Suit Vs Criminal Case

Hi Sir,

Can you plz tell me the difference between Civil suit and criminal case when cheque is bounced? What can be the punishment in case of civil suit?

Criminal case provides for punishment in terms of jail or fine or both whereas in civil case there is no jail term or punishment but only recovery of money

Punishment can awarded in a Criminal Case - while Civil Case means recovery - both can be persued to gether.

The criminal case is governed by provisions of Section 138 of Negotiable Instruments Act, 1881 and provides for imprisonment and / or fine, whereas civil suit is concerned with recovery of money.
