cheque dishonoured

dear sir , i had given a cheque to some one from my pvt . ltd. company the person lodged the cheque without informing me and it was dishonoured he did not even tell me about that and again lodged the cheque after one month and again after 2 months and now he has send me a notice.although i sincerely intend to pay him but right now i am not in a position to do so .there was no notice sent to me for 1st and 2nd dishonour kindly tell me what should i do?

You should make the payment soonest possible; and meanwhile inform him of your intention to pay by writing a letter.

If you have genuenly to pay this amount, pay the amount immediately without waiting any further. Do not wait for any court summons or warrants to be issued against you. Cheque bouncing is a serious offence.

You should not have issued a cheque when you were not in position to pay. However now you have to pay him or defend the case u/s 138 NI Act
