your question is not clear. If you are the drawer,and if sufficient funds were there to honour the cheque but the bank has given an incorrect return, then you will have to establish your bonafides in this case. Better ask a more intelligible question and not like this

if the money was lying in the account, 138 will not be attracted as there was difference in signature. But why and how the bank gave a different reasoning that the actual one? It is not clear from your request and question.
