Legal Question in Civil Rights Law in India

Company not paying last working month salary:

Hello sir,

I am trapped in tricky situation

I've served 15 days notice instead of 3 months. As per company's appointment letter, it has policy of 3 months in lieu 3 months basic

Totally company has holded on my 1 month full salary including (15 days served notice), relieving & experience letter.

Company has accepted my resignation through corporate email. now when I've joined new organization after couple of months company has send notice through lawyer saying that it has rejected your 15 days notice now you have to pay 3 month basic.or will file a civil case!

I am willing to pay unserved notice period (in this case : 2 month and 15 days) but they are asking full 3 month basic?

This is really unethical practice of company to do so...but don't know what should i do?

company is also not mentioning anywhere in notice/warning letter regarding full & final settlement! including my 30 days salary.

What could be my options? Please help me

Also even if they don't consider my 15 days notice , are they obliged to give that days salary?

Re: Company not paying last working month salary:

Dont worry. The are not going to file any case against you. The company will be really stupid if they file any such case.

Otherwise also they have no business to harass you after such a long time has passed. If they had any objections they should have raised at the time when the resignation was accepetd.

Enjoy and work hard in your new job.
